Lawsuit File in Crash Which Killed Woman From Shelby County

On Friday, October 28, a lawsuit was filed relating to a crash in 2015 which killed a woman from Shelby County and injured her infant son.

The wrongful death lawsuit was filed against Meritor WABCO Vehicle Control Systems of Michigan by Nathan Matson, husband of the late Jordan Mays Matson, and father of Maddoc Matson.

The lawsuit claims that in the accident, which happened around 8.15 a.m. on October 20, 2015, the vehicle Jordan and Maddoc were riding in collided with a Miller & Son tractor, pulling a Covenant trailer. It claims that the cause of the accident was that a valve in the breaking system of a tractor-trailer rig failed, preventing the truck from being able to stop. The valve was manufactured by Meritor and was defective under Alabama law at the time of the crash. Jordan was killed and Maddoc was injured.

The lawsuit seeks an unspecified amount of compensatory and punitive damages on claims of wrongful death, product liability, failure to warn of defects, and negligent/wanton maintenance against as yet unnamed parties.

The truck driver, 40 year old Chassidy Renae Garner-James of Mississippi was recently indicted by a grand jury on a charge of criminally negligent homicide for “operating a semi-truck with a defective brake system which was known to the defendant” and is being held in the Shelby County Jail in lieu of $15,000 bond.
